The Anglo-Saxon TRUST is established in England, through an authorised English law lawyer registered with SRA, even if they include assets located in other European countries. The Anglo-Saxon TRUST must be drafted to suit the client’s needs hence there is no standard model, therefore it must be tailored according to the needs of the interested parties. The Anglo-Saxon TRUST can be defensive or purposeful: the first is established with the aim of protecting the assets; the second for a specific purpose (for example the future economic support of a child).
The Anglo-Saxon TRUST in turn can be established: revocable or irrevocable.
- The revocable TRUST has a fixed duration that does not exceed 100 years, to avoid triggering a chain of fideicommissary substitutions, effectively blocking the circulation of assets, especially real estate.
- The irrevocable TRUST whose effects can cease before the expiration at the request of the settlor who regains possession of the assets initially conferred.
The Anglo-Saxon TRUST allows to satisfy multiple needs allowing to pursue different purposes, such as:
- Asset Protection;
- Generational transmission of wealth;
- Administration of family assets;
- Protection of minors and incapacitated persons;
- Often replaces the will.
The TRUST falls into the category of instruments for the protection and safeguarding of assets.
